1. About these Terms

These Terms of Service (the “Terms”) govern your access to and use of the OneSIM website, mobile interfaces, SIM/eSIM connectivity services, prepaid plans, support services, and any related products or features made available by ONECONNECT LTD (“OneSIM,” “OneConnect,” “we,” “us,” or “our”).

By creating an account, purchasing a plan, activating a SIM or eSIM, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility

You may use the Services only if:

You are at least 18 years old, or the age of legal majority in your jurisdiction

You have legal capacity to enter into a binding contract

Your use of the Services is not prohibited by applicable law, export controls, or sanctions restrictions

If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. Sanctions, Export Controls, and Restricted Use

You represent and warrant that:

You are not a person or entity subject to EU, UN, UK, US, or other applicable sanctions or asset-freeze measures relevant to the Services

You are not owned or controlled by any such person or entity where such ownership or control would make the provision of the Services unlawful or commercially prohibited

You are not located in, ordinarily resident in, or using the Services from a jurisdiction or territory where we do not lawfully offer the Services

You will not use the Services in a manner that would cause ONECONNECT LTD, its payment providers, or its network partners to violate applicable sanctions, export controls, or trade restrictions

We may block, refuse, suspend, restrict, or terminate access to the Services, transactions, or payouts immediately, with or without notice, where required for sanctions, export-control, fraud, legal, regulatory, or payment-provider compliance. To the maximum extent permitted by law, we are not obligated to provide the Services, process a transaction, or issue a refund where doing so would violate or risk violating applicable law or compliance obligations.

We may maintain and update a list of restricted countries, territories, destinations, counterparties, or use cases from time to time on our website, checkout flow, or support materials.

4. Our Services

OneSIM provides mobile connectivity and related digital communications services, including without limitation:

Prepaid SIM and eSIM plans sold for a fixed service term shown at checkout

Access to partner mobile networks in supported countries and regions

Account management and support features

Optional add-on services, security-oriented connectivity features, and number-based services where available

Service availability, supported countries, coverage quality, speeds, latency, routing, security features, phone numbers, and network compatibility may vary by destination, device, local carrier, infrastructure, regulation, and plan type.

5. Account Registration and Security

To access some or all Services, you may need to create an account and provide accurate, current, and complete information. You are responsible for:

Keeping your login credentials confidential

All activity under your account

Promptly updating inaccurate account information

Notifying us immediately of any unauthorized access or suspected compromise

We do not require KYC from ordinary subscribers as a standard condition of purchase or use. We may, however, request limited account, transaction, or business verification information where reasonably necessary for fraud prevention, payment-provider requirements, telecom-partner requirements, legal compliance, or support of business accounts.

6. Device and Compatibility Requirements

You are responsible for ensuring that your device is unlocked, eSIM-compatible where relevant, and technically capable of using the Services. We do not guarantee compatibility with every handset, operating system, router, modem, wearable, or device configuration.

7. Orders, Activation, and Provisioning

When you purchase a prepaid plan or other one-time service term, you authorize us to provision digital connectivity services to your account or device. Delivery may occur instantly or shortly after payment, but activation timing can depend on technical, carrier, transaction review, fraud review, or regulatory checks.

We may delay, reject, or cancel an order where:

Payment is not authorized or is reversed

Fraud, abuse, or suspicious activity is suspected

Required information or verification is missing

A plan, country, or feature becomes unavailable

We are required to do so by law or by a network partner

8. Plans, Payment, and Service Term

At this time, OneSIM Services sold through the website are offered on a prepaid, one-time purchase basis only.

When you buy a OneSIM plan, you pay upfront for the fixed service term selected at checkout. Depending on the offer presented at checkout, available prepaid terms may include 1 month, 6 months, 12 months, or other fixed periods that we may make available from time to time.

Unless a specific offer expressly states otherwise:

Your purchase is a one-time prepaid purchase for the selected service term

There is no automatic renewal and we do not charge that purchase again unless you place a new order

If you want continued service after your current prepaid term ends, you must place a new order and pay the then-current price

Failed payments may result in the relevant order not being completed or the requested Service not being provisioned

Where required by applicable law, we will present key commercial information before you place the order, including the prepaid nature of the purchase, the price, the selected service term, and any material conditions that apply to the Service.

You are responsible for all taxes, duties, levies, and governmental charges associated with your purchase, except taxes based on our net income.

Where you choose to save a payment method to your account for future one-time purchases, that payment method will be stored and processed by our payment provider in accordance with applicable payment card industry standards. You may remove a saved payment method from your account at any time through your account settings. Saved payment method details cannot be edited in place; to update payment details you must remove the existing method and add the new one. A saved payment method will never be charged automatically. Every charge requires a new order placed by you.

9. Pricing and Promotions

We may offer promotional pricing, referral credits, discounts, bundle offers, or trial arrangements from time to time. Unless explicitly stated otherwise:

Promotions are temporary and may be withdrawn at any time

Promotions cannot be combined

Credits have no cash value and are non-transferable

Promotional eligibility may be subject to anti-abuse, regional, payment, identity, or account-level restrictions

Where we operate a referral or invite programme, specific terms governing eligibility, reward amounts, credit expiry, stacking restrictions, fraud disqualification, and programme modifications will be set out in the relevant programme terms published on our website or within your account. In the event of any conflict between those programme terms and these Terms, these Terms shall prevail.

10. Right of Withdrawal, Early Performance, and Activation

Where required by applicable consumer law, consumers may have a statutory right to withdraw from certain distance contracts within a cooling-off period.

If you ask us to begin providing the Service during that period, including by requesting immediate activation, provisioning, download, or use of a SIM/eSIM plan, you expressly request immediate performance of the contract.

Where permitted by applicable law:

If the Service has been fully performed during the withdrawal period after your express request and required acknowledgements, your withdrawal right may be lost

If you withdraw after requesting early performance but before full performance, we may retain or charge a proportionate amount for the Service actually provided up to the time of withdrawal

Where a product, feature, or component qualifies as digital content or a digital service for which specific withdrawal exceptions apply, your withdrawal right may be limited or lost once the relevant legal conditions are met

Nothing in these Terms limits any non-waivable consumer rights under applicable law.

11. Acceptable Use

You agree not to, and not to permit any third party to:

Use the Services for unlawful, fraudulent, abusive, or misleading purposes

Resell, clone, route, redistribute, or commercially exploit the Services except where expressly authorized in writing by us

Interfere with network integrity, platform stability, or security controls

Use the Services for spam, phishing, malware, scraping, denial-of-service activity, SIM farms, call pumping, traffic inflation, artificial usage generation, or other abusive patterns

Circumvent geographic, technical, identity, fair use, or security restrictions

Infringe intellectual property or privacy rights

Use a single SIM or eSIM as a permanent domestic substitute in one country in a manner that violates applicable roaming regulations or the fair-use or anti-permanent-roaming requirements of our network partners

Use the Services in a manner that could expose us, payment providers, carriers, or partners to legal, regulatory, or reputational risk

We may apply fair use limits, traffic management, anti-fraud controls, velocity checks, roaming restrictions, or destination-specific limitations where reasonably necessary to protect the network, other users, our partners, or the integrity of the Services.

Use of the Services in a single country may be subject to cumulative time or usage limits under applicable roaming regulations or network partner requirements. Where such limits apply, they will be communicated in the relevant plan description, fair use policy, or support materials.

12. Coverage, Speeds, and Service Availability

We aim to provide reliable service, but the Services are provided on an “as available” basis. We do not guarantee uninterrupted availability, continuous coverage, minimum speeds, latency, successful handoff between networks, or compatibility in all locations.

Coverage and performance can be affected by local network conditions, buildings, geography, weather, power outages, device limitations, third-party carrier issues, government restrictions, lawful interception requirements, maintenance, congestion, or other factors beyond our control.

Coverage, speeds, and access to specific networks may also be affected by anti-permanent-roaming controls, local regulatory restrictions on roaming services, or network partner fair-use policies applicable to the relevant destination or plan.

13. Security Features and Limitations

Where we describe privacy, security, or private-routing features, those features are intended to improve confidentiality, control, or risk posture compared to ordinary consumer connectivity. They do not constitute a guarantee that communications are fully anonymous, immune from interception, invulnerable to attack, or suitable for every regulated, classified, emergency, or mission-critical use case.

You remain responsible for your own endpoint security, passwords, device updates, encryption, and operational security practices.

14. Emergency and Critical Services

OneSIM Services must not be treated as a primary emergency communications service unless a specific plan page, product description, and applicable pre-contract disclosure expressly states that emergency calling support is included for that specific Service.

Even where emergency calling support is expressly stated for a specific Service, availability may still depend on the device, local carrier support, network conditions, coverage, power, location information, jurisdiction, and other factors outside our control.

You must maintain an alternative means of contacting emergency services and must not rely on the Services for life-critical, medical, safety, or emergency purposes.

15. Third-Party Services, Networks, and Legal Requests

The Services rely in part on third-party mobile network operators, infrastructure providers, payment processors, identity verification providers, cloud providers, analytics tools, and other vendors. We are not responsible for outages, acts, omissions, delays, or policy changes by such third parties, except as required by law.

Because the Services operate in regulated communications environments, use of the Services may be subject to lawful disclosure, lawful interception, traffic-management, fraud-prevention, sanctions-screening, recordkeeping, or other legal or regulatory obligations imposed on us or our service providers under applicable law. Nothing in our descriptions of privacy or security features should be interpreted as eliminating such obligations.

16. Intellectual Property

All content, trademarks, service marks, logos, software, user interfaces, text, graphics, documentation, and platform elements associated with the Services are owned by us or our licensors and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose. No ownership rights are transferred to you.

17. Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Services immediately, with or without notice, if:

You breach these Terms or any policy we publish

Payment fails or a chargeback is initiated

Fraud, abuse, prohibited use, or unusual risk is detected

We are required by law, sanctions, court order, or regulatory instruction

A third-party supplier or carrier withdraws support

Continued service would create security, legal, or operational risk

You may stop using the Services at any time. If you choose not to buy another prepaid term after your current term ends, the relevant Service will simply expire at the end of that prepaid term unless otherwise stated in a specific offer or required by law.

Sections that by their nature should survive termination shall survive, including provisions relating to fees owed, refunds, intellectual property, privacy, disclaimers, limitations of liability, dispute resolution, and fraud prevention.

18. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

19. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted operation.

Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded under applicable consumer law.

20. Limitation of Liability

To the maximum extent permitted by law, ONECONNECT LTD and its directors, officers, employees, affiliates, contractors, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of data, or business interruption, arising out of or related to the Services.

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Services shall not exceed the total amount paid by you to us for the specific Service giving rise to the claim during the three (3) months preceding the event giving rise to liability.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability that cannot be excluded under applicable law.

21. Indemnity

You agree to indemnify and hold harmless ONECONNECT LTD and its affiliates, officers, employees, contractors, licensors, and partners from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to your misuse of the Services, breach of these Terms, violation of law, or infringement of any rights of a third party.

To the extent you are acting as a consumer, this indemnity applies only to the extent permitted by applicable mandatory consumer law.

22. Changes to the Services or Terms

We may update the Services, pricing, plans, coverage, technical specifications, partner relationships, or these Terms from time to time. Where legally required, we will provide notice of material changes.

For changes that materially affect price, core service characteristics, duration, termination, or your legal rights, we may provide specific advance notice by email, in-app notice, account notice, or another durable medium where required by law. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms, except where applicable law requires a different form of notice, consent, or termination right.

23. Governing Law, Mandatory Consumer Rights, and Complaints

These Terms are governed by the laws of the Republic of Cyprus, excluding conflict of law principles.

If you are a consumer, you continue to benefit from any mandatory rights and remedies granted to you by the consumer laws of your country of habitual residence, to the extent those protections cannot lawfully be excluded or limited by contract.

We encourage you to contact us first to resolve any complaint. Where applicable law provides additional redress routes, you may also have the right to refer an unresolved dispute or complaint to a competent consumer ADR body, consumer authority, or national regulatory authority with jurisdiction over electronic communications or consumer disputes.

For customers dealing with ONECONNECT LTD in Cyprus, this may include, where applicable to the type of service provided and the regulatory status of the relevant provider, the Office of the Commissioner of Electronic Communications and Postal Regulation (OCECPR), as well as, where applicable, a competent consumer ADR body.

Any dispute not resolved amicably shall be submitted to the competent courts of Cyprus, unless applicable mandatory consumer law requires otherwise.

24. General Provisions

Severability

If any provision of these Terms is found to be illegal, invalid, or unenforceable under applicable law, it shall be modified to the minimum extent necessary to make it enforceable. If such modification is not possible, the affected provision shall be severed from these Terms, and the remaining Terms shall continue in full force and effect.

Non-Waiver

Failure by us to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or of any other provision. No single or partial exercise of any right or remedy shall preclude any further exercise of that right or remedy.

Assignment

We may assign, transfer, or novate our rights and obligations under these Terms to any affiliate, group company, or successor entity, including in connection with a merger, acquisition, reorganisation, or asset transfer, without requiring your consent. You may not assign your rights or obligations under these Terms without our prior written consent.

Language

These Terms are drafted in the English language. Where translations are made available, the English version shall prevail in the event of any conflict or inconsistency.
